Representation in MEB and PEB Hearings

The Physical Evaluation Board (PEB) is an administrative body that exists in each branch of the armed forces. The primary purpose of the board is to evaluate cases of physical disability, determining the extent of the disability and whether it was incurred during a service member's period of active duty.

Medical Evaluation Boards (MEB)

In an MEB hearing, a panel of doctors makes an assessment of the service member's disability and assigns a disability rating. If the service member is pleased with the rating, the process stops at this level. However, if he or she wants to obtain an additional review in the hopes of securing a higher rating, the case proceeds to a PEB hearing.

Physical Evaluation Boards (PEB)

After the preliminary MEB hearing, a service member will be evaluated by the Physical Evaluation Board (PEB). If the PEB determines that the disability is service-related, they will assign their own disability rating. Please note, the PEB is not bound by the findings of the MEB.

Disability Ratings

  • Disability rating of 30% or higher — If the service member receives a disability rating of at least 30%, he or she is transferred to the Temporary Disability Retired List (TDRL). The service member may be evaluated for the next five years. If the disability does not improve after this time, the service member is considered medically retired.
  • Disability rating of less than 30% — If the service member is determined to have a disability rating of less than 30%, he or she is given disability severance.
  • No disability — If the service member is determined to have no disability, he or she is retained on active duty.
