Navy Region Southwest, San Diego, California (July 2010) - Ms. Temple negotiated an alternative disposition to a pending administrative separation board for alleged fraud brought against a retirement-eligible Navy reservist. Ms. Temple's client will retire from the United States Navy as an E-7. McChord AFB, Washington (June 2010) - an Air Force NCO received his reenlistment bonus in excess of $30,000 as a result of a persuasive application filed by Ms. Temple with the Board for Correction of Military Records. Ms. Temple had previously defended the member against false allegations of sexual assault. McChord AFB, Washington (June 2010) - Ms. Temple represented a 21-year SNCO before a Special Court-Martial. Ms. Temple successfully protected a projected $2M in military retirement benefits for her client by avoiding a punitive discharge at trial. The member will retire November 2010. U.S Army Human Resources Command, St. Louis, Missouri (April 2010) - Ms. Temple appealed an IRR recall for a former Army Specialist on the basis of medical disqualification and enrollment in full-time education, which was granted, allowing her client to remain enrolled in college. Ft. Rucker, Alabama - Mr. Kelley defends a soldier charged fwith manslaughter. Found not guilty by general court-martial Fort Jackson, South Carolina – Through Ms. Temple’s astute representation, an Army Drill Sergeant and E-7-select was found not guilty of all charges stemming from accusations of an improper sexual relationship with a trainee. The member promoted to E-7 effective August 1, 2009. McChord Air Force Base, Washington – Ms. Temple’s zealous advocacy of an Air Force NCO at an Article 32 pretrial investigation for sexual assault and forcible sodomy led to dismissal of charges prior to trial. Her client will be allowed to reenlist for another tour. Naval Station, Bremerton, Washington – Ms. Temple represented a Navy sailor facing a general discharge for alcohol treatment failure. Ms. Temple’s diligent research and letter to the sailor’s command resulted in retention of the sailor on active duty pending completion of his term of service. Fort Knox, Kentucky - Mr. Kelley successfully defends an Army NCO before a BCD-Authorized special court-martial. Findings: Not guilty of all the charges and all specifications. Marine Corps Base, Quantico, Virginia - At a special court-martial tried by Ms. Temple. A Private who missed movement by design, avoiding deployment to Iraq, and was absent from his unit without authorization for over two months faced up to one year in jail, but spent only 17 days in post-trial confinement before returning to his home where he is a single father. U.S. District Court, Washington, D.C. - Mr. Saran obtained a stay from a federal judge preventing Coast Guard from discharging a Warrant Officer facing administrative discharge. Pittsburgh, Pennsylvania - Ms. Temple successfully filed a request for redress on behalf of an Army National Guard member scheduled to deploy to Iraq. The member suffered from a serious medical condition, which could have been life-threatening if she had deployed. Through astute legal research and advocacy skills, Ms. Temple helped prevent a perilous situation for a dedicated service member. Washington Naval Yard, D.C. - A sailor discharged in 1993 with an OTH for drug use had the DD-214 upgraded to general under honorable conditions as a result of Mr. Saran's petition on the client's behalf and representation before the Naval Discharge Review Board. Fort Jackson, South Carolina - A drill sargeant facing a BCD-special court-martial for over 10 specifications of conspiracy, assault, and abusing recruits instead received a general discharge under honorable conditions. Mr. Saran recently defended a Marine facing sexual assault charges under the "new" Article 120, UCMJ. Mr. Saran won a motion at trial and the judge declared portions of the new statute unconstitutional and the charge was dismissed in its entirety. The government has appealed and the case was heard before the Navy-Marine Corps Court of Appeals. That decision was appealed to the Court of Appeals for the Armed Forces. The government subsequently withdrew and dismissed all charges. The Accused Marine has now been promoted to Corporal. Moody Air Force Base, Georgia: Airman not guilty of rape at general court-martial. Headquarters, U.S. Marine Corps: Marine Harrier pilot returned to flying status at pilot competency board. Ft. McClellan, Alabama: Army noncommissioned officer drill sergeant not guilty of recruit misconduct at special court-martial. Army Board for Correction of Military Records: Reserve noncommissioned officer’s forced separation from adverse administrative separation hearing. Soldier reinstated to duty. Los Angeles Air Force Base, California: Air Force officer not guilty of rape at general court-martial. Army Discharge Review Board: Board upgrades Army warrant officer’s Other than Honorable discharge. Ft. Rucker, Alabama: Army officer not guilty of rape allegations at general court-martial. Air Force Board for Correction of Military Records: Retired Air Force captain reconsidered for promotion. Upon reconsideration, selected and promoted to the rank of major. Restored to duty at new rank with back pay and allowances. Army National Guard: No misconduct finding at administrative separation proceedings for noncommissioned officer accused of drug use. Naval Station, Jacksonville, Florida: Board of inquiry dismissed all charges against active-duty Navy captain (O6). Department of Justice, Washington, DC: Army general officer cleared of standards of conduct allegations. Retired at general officer rank. Camp Lejeune, North Carolina: Article 32 Investigation clears Marine staff noncommissioned officer of manslaughter allegations. Charges dismissed.
